We are happy to accept returns within 14 days (change of mind or “cooling off” period) of your order for standard stock products only. If we have already dispatched the product, it needs to be returned to us at the address below before a refund can be applied. You will however be liable for the courier/delivery charge to return your item to us. Once we receive the goods in original packaging and condition (unused) we will process the refund. Refunds will not be provided for goods which do not match the above description.
Non-Standard Stock Products:
The “change of mind” or 14 day “cooling off” returns policy does not apply to Non-Standard Stock Products due to safety risks associated with used materials. These items will be listed as such in the description and refers to any items which are made to order and manufactured by our company to a specification. This includes; chains assemblies (all grades), tie down chains, chain slings, lifting chain assemblies, custom webbing slings, along with any product which was specifically designed for an application. These items are not covered under EU consumer rights directive legislation as they are customised and likely to deteriorate/expire quickly with use. Please note that items which are Standard Stock Products but are shrink wrapped for protection can NOT be returned under 14 day cooling off period if protective shrink wrap which has been applied during production is opened or damaged as this renders the item used. This applies to Web slings and Roundslings.
Faulty Products:
If you receive your items and you notice a “major” fault (preventing the item from working from the outset), you must write to us immediately notifying us of the fault and we can organise a refund or replacement. We must however receive the faulty goods in original packaging and condition (unused) before we can process the refund. We will pay for the courier/delivery charge to return your item (ask us can we organise a pick & collect service with our courier to make it easy).
Special Order Policy:
Our normal return policy does not apply to any “Special Order” purchases. “Special Order” purchases are not returnable for refund or for credit of any kind. Payment of Special-order items will be required in full before the order can be processed. All special-order items will be processed in the most efficient and timely manner possible but as the order is “special” or “one-off” Lifting Equipment Sales Ltd trading as LiftingEquipment.ie is not responsible for delays beyond our control and at the time of ordering a special order item, it is the customer's responsibility to obtain an estimated (approximate) time of arrival. No cancellations will be honored and refusal of a special-order shipment does not constitute right to a refund.
Individual Consumers – Standard Stock Products
An individual consumer is a person purchasing goods wholly or mainly for purposes outside their trade, business, craft or profession.
Where an individual consumer purchases standard stock products online or by telephone, they may cancel the order at any time before receiving or collecting the goods, or within 14 days after they, or a person nominated by them, take physical possession of the goods.
The customer must clearly notify us of their decision to cancel within this period by emailing accounts@liftingequipment.ie, calling us on 093 26300 or otherwise providing a clear statement that they wish to cancel.
After notifying us of the cancellation, the goods must be returned to us within a further 14 days.
Unless the goods are faulty, damaged or incorrectly supplied, the customer is responsible for the direct cost of returning them.
Where applicable, we will refund the price paid together with the cost of our standard delivery service. Additional delivery costs arising from the customer selecting an enhanced or premium delivery service will not be refunded.
Refunds will be made using the original payment method unless otherwise agreed. We may withhold the refund until the goods have been returned to us or the customer provides satisfactory evidence that they have returned them.
For standard stock products purchased directly at our premises, there is no statutory change-of-mind return right. However, we are happy to consider returns requested within 14 days of purchase, subject to proof of purchase and the goods being unused, in their original packaging and in a fully resaleable condition.
Condition of Returned Goods
Individual consumers are entitled to inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning.
The customer may be responsible for any reduction in value caused by handling, use, marking, damage or contamination beyond what was reasonably necessary to inspect the goods.
Original packaging should be retained and returned where reasonably possible.
Due to the safety-critical nature of lifting equipment, all returned goods will be inspected before being accepted back into stock.
For voluntary business-to-business returns, protective wrapping or shrink wrapping applied to products including web slings and round slings must remain intact. Goods with opened or damaged protective wrapping may be refused where they can no longer reasonably be sold as new.
Business Customers
Purchases made by or on behalf of a limited company, partnership, sole trader or other organisation wholly or mainly for trade or business purposes are business-to-business transactions. Statutory consumer cooling-off rights do not apply to these purchases.
Returns of standard stock products by business customers are accepted only at our discretion.
A business customer must request a return within 14 days after delivery or collection of the goods. The return must be approved by us in writing before the goods are sent back.
Where a return is approved, the goods must be physically returned to us within 14 days after our written approval. Merely notifying us of an intention to return goods does not create an indefinite return period.
Returned goods must be unused, unmarked, in their original packaging and in a fully resaleable condition. Refunds or credits will only be processed after the goods have been received, inspected and accepted by us.
Delivery and return costs are not refundable on business change-of-mind returns unless otherwise agreed by us in writing.
Business Collection Orders and Uncollected Goods
Business collection orders should be collected within 30 days after we notify the customer that the goods are ready.
Where goods have not yet been collected, any request by a business customer to cancel the order must be made within 14 days after we notify them that the goods are ready for collection and must be accepted by us in writing.
Failure to collect paid goods does not cancel the order and does not create a right to a refund. The goods will remain available for collection by the business customer, subject to this policy.
Where an order remains uncollected after 30 days, we may issue a final written collection notice. We reserve the right to apply reasonable storage or handling charges from the date specified in that notice.
Where goods remain uncollected after the final collection notice has expired, we reserve the right to take any further steps available to us by law. Paid goods will not be disposed of or resold without appropriate prior written notice and any process required by law.
Non-Standard, Customised and Made-to-Order Products
The consumer change-of-mind or cooling-off right does not apply where goods are non-prefabricated and have been manufactured or assembled following the customer’s individual choice or specification, or where goods have been clearly personalised.
This may include:
- Custom chain assemblies
- Tie-down chain assemblies
- Chain slings and lifting chain assemblies
- Chains manufactured to a specified length or configuration
- Custom webbing slings
- Products individually marked or personalised
- Products manufactured or configured for a particular customer or application
This exclusion applies only where the product has genuinely been manufactured, assembled, configured or personalised according to the customer’s individual requirements.
For business customers, custom-made, non-standard and special-order products cannot be cancelled or returned for refund or credit once the order has been accepted or production or procurement has commenced, unless otherwise agreed by us in writing.
Payment for custom-made, non-standard or special-order products may be required in full before the order is processed.
Any estimated delivery or completion date provided for a special-order item is an estimate only. We will not be responsible for reasonable delays outside our control.
Nothing in this section affects any applicable rights where goods are faulty, damaged, incorrectly supplied or do not conform to the agreed order.
Faulty, Damaged or Incorrectly Supplied Products
This change-of-mind returns policy does not affect the statutory rights of individual consumers or any applicable contractual rights relating to faulty, damaged or incorrectly supplied goods.
Please notify us as soon as reasonably possible if you believe that goods are faulty, damaged or different from what was ordered. Please provide the order or invoice number, details of the issue and photographs where appropriate.
Where we are responsible for the return of faulty, damaged or incorrectly supplied goods, we will arrange collection or reimburse the reasonable return cost, as applicable.
Customers should not use any lifting equipment they believe may be defective or unsafe.
Arranging a Return
Before returning goods, please contact our team so that we can provide return instructions and, where required, confirm that the return has been authorised.
Contacting us for return instructions does not restrict an individual consumer’s right to cancel a distance contract by providing any clear statement of cancellation within the applicable cancellation period.
